A. The Terms

1. Acceptance of Terms

Welcome to BookMyGuru (“Service” or “Site”), owned and operated by BookMyGuru LLC (“BookMyGuru” or “we” or “us” or “our”). By signing up on the account registration or using the Site in any way, you agree to comply with and be bound by this Agreement, the Privacy Policy, and all rules, policies, and disclaimers posted on the Site or about which you are notified (collectively “Terms”). Please review all of the Terms carefully before using the Site.

By using the Site, you (i) agree to be bound by the Terms, (ii) represent that you are over the age of thirteen (13) and able to form legally binding contracts, (iii) agree and acknowledge that by using the Service you are accepting a benefit that cannot be reversed, (iv) acknowledge that the service is subject to U.S. export controls and agree that you will comply with U.S. export controls, and (v) represent that you are neither located in a sanctioned country nor a prohibited person.

PLEASE NOTE that these Terms provide that any disputes that arise between you and BookMyGuru will be resolved by binding arbitration and not through court action. Additionally, any claims or disputes cannot be brought as a class action. Please carefully review the Dispute Resolution section below. If you do not agree with the arbitration provision, you may not use the Site.

2. Definitions

• "User", "you", and "your" refer to the individual or entity that creates a BookMyGuru account.
• "BookMyGuru", "we", "us", and "our" refer to BookMyGuru LLC.
• "Customer" refers to individuals seeking advice or expertise through the platform.
• "Guru" refers to individuals providing expertise or guidance via the platform.

3. Communications and Right to Modify Terms

When you interact with BookMyGuru, including through emails, text messages, calls, video calls, and push notifications, you consent to receive communications from us through these means. You agree that all agreements, notices, and other communications that we provide electronically satisfy any legal requirement that such communications be in writing.

BookMyGuru reserves the right to modify any of the Terms at any time by posting them on the Site. Changes will automatically be effective upon posting. For material changes, we will provide notice through email or other conspicuous methods. Your continued use of the Service signifies your acceptance of the changes. If you do not accept the changes, your sole remedy is to discontinue using the Site.

B. The Website

5. BookMyGuru is a Venue; Third-Party Content

BookMyGuru is a venue for informational and educational purposes, connecting Gurus with Customers who seek their expertise. Gurus are independent service providers using the Site to sell their expertise to Customers. BookMyGuru does not directly provide the content of advice or expertise; instead, we serve as a platform where Users exchange knowledge.

BookMyGuru is not responsible for the content shared between Customers and Gurus. We do not guarantee the performance or accuracy of any Guru’s advice, nor do we ensure that a Guru will respond to a query. However, we reserve the right to remove content or restrict access to the Site at our discretion.

6. Posts Are Not Private or Confidential

All communication through BookMyGuru, including messages, posts, and other interactions, is not confidential and may be read by others, including search engines indexing this content. If you wish to keep your communication private, you must explicitly request this through the appropriate settings on the Site.

7. Verification of Gurus

BookMyGuru verifies that Gurus have at least one credential relevant to their area of expertise. However, this verification is based solely on the information provided by the Guru or a third-party verification service. BookMyGuru does not warrant or guarantee the accuracy of the information provided by Gurus.

C. User Accounts

9. User Accounts; Termination of Service

As a User, you are responsible for maintaining the confidentiality of your account information. You agree to notify BookMyGuru of any unauthorized use of your account. If your account is terminated or suspended, you may not create another account without permission.

Customers can terminate their accounts by written notice to us at any time. BookMyGuru reserves the right to restrict or terminate your access to the Service for any reason, with or without notice.

D. Legal Statements

16. Exclusion of Warranties

BookMyGuru Services are provided “as is” without any warranty, either express or implied. We do not represent or warrant that the Service will be uninterrupted or error-free. Your use of the Site is at your own risk.

17. Limitation of Liability

Under no circumstances shall BookMyGuru be liable for any indirect, special, incidental, consequential, punitive, or exemplary damages arising out of your use of the Site. Our liability to you for any reason will not exceed $100 or the total amount paid by you in the 12 months preceding the incident.

18. Indemnification

You agree to indemnify and hold BookMyGuru harmless from any claims, damages, or expenses arising out of your use of the Site, including interactions with other Users.

E. Dispute Resolution

21. Arbitration Agreement

If a dispute arises between you and BookMyGuru that cannot be resolved informally, it will be resolved through binding arbitration. You and BookMyGuru agree to waive the right to a jury trial or participation in a class action.

22. Choice of Law

These Terms are governed by the laws of the State of California without regard to its conflicts of law principles.

F. Miscellaneous

23. Entire Agreement

These Terms constitute the entire agreement between you and BookMyGuru and supersede any prior agreements.
